1. Agreement to Terms

These Terms of Service (“Terms”), including the Content License in Section 16, form a binding agreement between you and PoundCake (the operator of poundpoundcake.com; legal entity name: [PLACEHOLDER for counsel]) regarding the adult creator brand PoundCake and poundpoundcake.com (the “Site”).

By accessing the Site, passing an age gate, checking assent boxes, completing a purchase, requesting a custom, booking a virtual date, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the Site or purchase.

Independent storefront. You are not required to leave OnlyFans or any other platform to buy here. Soft non-circumvention: do not use Site communications primarily to evade another platform’s payment rules. We may refuse orders that appear to do so.

2. Adult audience; age gate; digital assent

The Site and all content are solely for adults. You represent you are at least 18, or the age of majority if higher, and that you are not accessing from a jurisdiction where adult content is illegal for you.

Checking “I am 18+,” agreeing to the Terms and Content License, clicking Purchase, completing checkout (crypto customs or Stripe for non-customs), or similarly manifesting assent is electronic signature / digital assent (including, where applicable, ESIGN / UETA). 3. Accounts, communications & conduct

4. Products & services

We may offer digital photographs, videos, audio, custom content, virtual private video calls marketed as a “Date with PoundCake,” merchandise, and promotional games or sweepstakes (subject to Official Rules).

Customs: crypto-first. Default tender is cryptocurrency — USDT (ERC-20 on Ethereum) preferred; ETH alternate on the same Ethereum receive address; BTC alternate on Bitcoin mainnet (native segwit). PoundCake will provide a per-order invoice and/or public receive address on /customs or in writing. Customs payment structure: 100% prepaid in crypto before production starts / before the brief is accepted into production. Payment received locks the order. There is no later balance before delivery.

5. “Date with PoundCake” — virtual sessions only

“Date with PoundCake,” “virtual date,” “private video call,” and similar phrases mean a scheduled, live, virtual audiovisual interactive session with the PoundCake persona, delivered online.

5.1 Express exclusions

• In-person meetings, escorting, prostitution, or any IRL sexual services
• Travel-for-sex, “fly me out,” hotel arrangements as a sexual service, or companion services
• Any offer that would be unlawful

Any request to convert a virtual booking into IRL sexual contact will be refused and may result in cancellation without refund if the request violates law or these Terms after booking.

5.2 Geography

Virtual sessions and prize fulfillments are offered only where lawful. Void where prohibited.

5.3 Recording

Buyer recording, screen capture, streaming, or taping is prohibited unless you purchase an express recording add-on and receive written confirmation. Unauthorized recording is a material breach and triggers immediate license revocation.

PoundCake may record sessions for safety, quality, or dispute purposes.

5.4 Scheduling, cancellation, no-shows

• Times confirmed in writing. Default reference zone: America/Chicago.
• Buyer cancellation: full refund if cancelled ≥ 48 hours before start; 50% if ≥ 24 and < 48 hours; no refund if < 24 hours, except where required by law or if we cause the cancel. [Placeholder windows for counsel.]
• Creator cancellation: reschedule in good faith or refund amounts paid for that session.
• Buyer no-show: fail to join within 10 minutes without notice — session may be forfeited with no refund.

6. Customs-specific terms

Your written brief becomes part of the order once we confirm acceptance and you pay. PoundCake retains creative and safety discretion and may refuse any element that conflicts with the hard-no list, wellbeing, law, or brand.

You will not request, and we will not create, content involving: minors or unverified adults; “barely legal” / ageplay-as-minor / CSAM; real non-consent or exploitation of third parties; scat, snuff, real severe gore; third parties without documented adult consent; bestiality; doxxing or revenge distribution; IRL sexual services or meetups; clear third-party IP infringement we decline.

6.4 Made-to-order; 100% prepaid; refunds; revisions

• Payment received means the full quoted amount (100% prepaid) has been confirmed on-chain.
• Payment locks the order. Once payment is received and the brief is accepted into production: no refunds for buyer remorse, change of mind, “doesn’t match fantasy,” delayed-but-delivered work, or chargeback fishing.
• Sole refund exception (total failure): we never deliver the agreed custom after payment and refuse a reasonable remake — or where mandatory law requires a remedy.
• Not 50/50. No later balance before delivery.
• Digital goods are final sale once delivered, subject only to the total-failure exception and mandatory law.
• One minor revision if requested within seven days of delivery. New concepts require a new purchase.

7. License model overview

Purchase grants a personal, non-exclusive, non-transferable, non-sublicensable license for private personal entertainment. Copyright and all IP remain with PoundCake / the creator. No copyright transfer.

Prohibited: redistribution, uploading, selling, torrenting, leaking, commercial use, or using content to train, fine-tune, or improve AI / ML models.

8. Right of publicity & persona

PoundCake’s name, likeness, voice, image, persona, and brand elements are protected. Deepfake or synthetic sexual media of PoundCake created from our content without authorization is prohibited.

9. User content & feedback

If you send ideas, briefs, or testimonials, you grant PoundCake a non-exclusive license to use feedback to operate the business. Briefs are used to fulfill your order.

10. DMCA / copyright complaints

Initiating a chargeback after delivery of conforming goods, after customs prepaid payment + production start, or without first contacting us, is a breach of these Terms and may be treated as fraud-report territory.

13. Disclaimers

THE SITE AND ALL CONTENT/SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUNDCAKE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUNDCAKE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO POUNDCAKE FOR THE SPECIFIC ORDER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

15. Indemnity

You agree to defend, indemnify, and hold harmless PoundCake, PoundCake, and their owners, employees, and contractors from claims arising out of your breach, misuse or unauthorized redistribution of content, violation of law, unauthorized recording, or infringement of third-party rights.

16. Content License (checkout acceptance block)

Subject to full payment and compliance, PoundCake grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and privately view purchased digital content (and to attend a purchased virtual session) for personal, non-commercial entertainment only.

All right, title, and interest remain with PoundCake and/or the creator. No copyright transfer. You shall not copy for others; upload/share; sell or sublicense; use commercially; bypass watermarks; use content for AI/ML training, scraping, dataset compilation, or generative model improvement; or remove copyright notices.

Upon breach (including chargeback abuse or leak), the license automatically terminates. Any “exclusive hold” is only the contractual non-relicensing period in your order — not an assignment of IP.

17. Privacy

See our Privacy Policy. We do not store full card numbers. Crypto customs payments are verified on public ledgers; we may store txids, amounts, asset/network, and order linkage — never seed phrases or private keys (we will never ask you for those).

18. Third-party services

Discord, Stripe (non-customs), blockchain networks / wallet software, hosting, email, and video-call tools are third-party services. You are responsible for sending crypto on the correct network to the correct address for your order.

19. Promotions, wheels & sweepstakes
